This digital media store, currently available at http://videostore.rr.com (the “Service”), is managed and published by iN DEMAND LLC (“iN DEMAND”), acting as an agent of and on behalf of Time Warner Cable Inc. and its affiliated or related entities (collectively, “Time Warner Cable,” or “Provider,” or “we” or “us”). This Privacy Policy (the "Privacy Policy") is incorporated into, and part of, the Digital Media Store Terms of Use and the Digital Media Player End User License Agreement, which govern your access to and use of the Service and its features in general.

By visiting or using this Service, you are agreeing to the terms of this Privacy Policy, which may be amended from time to time, so please review this Privacy Policy carefully and check this page frequently to view any changes. Such changes or modifications shall become effective immediately upon posting thereof, and in certain circumstances, we may seek to notify you through additional means, such as via e-mail. If you continue to use the Service after notice of changes have been sent to you or published on the Service, you thereby provide your consent to the changed practices.

This Privacy Policy applies to your use of the Service. This Privacy Policy does not govern Time Warner Cable’s treatment of information it collects and receives about you other than through this Service, for example in connection with any other services or websites provided to you by Time Warner Cable. Time Warner Cable also has a Subscriber Privacy Notice that applies to its cable services, which is located at http://help.twcable.com/html/policies.html. This Privacy Policy covers how Time Warner Cable treats information that Time Warner Cable collects and receives about you via this Service, including the personal information we collect through the various features, services, and software that we use to provide the Service to you. Some of these offerings are provided by third parties who may provide you with additional information and choices about your privacy. If you choose to take advantage of these offerings, you should read the privacy policies of such third parties.

Collection, Use, Accessing and Disclosure of Information

Information Collection

Whether you register for our Service, or are just a visitor, we try to be very careful with what we do with your information. Collection of information is usually grouped into two categories: (1) personally identifiable information, which is information identifiable to a specific user, and (2) non-personally identifiable, which is general demographic information (gender, age, zip code), as well as Service usage information (such as title popularity, pages visited, promotion participation levels), both of which do not generally identify any one individual.

We collect non-personally identifiable information when it is affirmatively provided or through a user’s online activity, for example, through “cookies” and other tracking technologies, which are discussed in greater detail below. We may use non-personally identifiable information for any purpose or disclose it to anyone, in our discretion.

Personal Information Collection

In many cases, you can view parts of the Service without providing any personally identifiable information. However, if you want to take advantage of the entertainment and other features we offer, including, for example, the many movie and television titles available for download and rental, we require you to register with the Service. This means opening a Service account and providing certain personally identifiable information, including, for example, your name, postal address in the United States, email address, age, a user name and password, your current cable television account number and provider, and, in order to make a purchase, you must provide us with your valid credit or debit card (all such personal information collectively, “Account Data”). You must provide and keep us up to date with accurate Account Data, including any changes to your address, email address, card number and/or expiration dates, and you agree that we may update your Account Data with information your bank or credit card issuer may supply without further notice to or permission from you.

Apart from registration, other circumstances where we also may collect personally identifiable information about you are when you choose to participate in sweepstakes or other promotions available on or through the Service, fill out surveys, complete polls, participate in open forums or other “public,” interactive or community areas (such as the comment boards on the Service), offer testimonials or send questions or comments to us via email or through other means of communications.

Any or all of the activities with regard to personally identifiable information as described above and elsewhere in this Privacy Policy, may be performed by us, or on our behalf by our agents and service providers (including, for example, iN DEMAND).

Non-Personally Identifiable Information Collection

We may use “cookies” to keep, and sometimes track, information about you. Cookies are small data files that are sent to your browser or related software from a Web server and stored on your computer's hard drive. Cookies track where you travel on our Service and what you look at and download. They may store, for example, the information in your shopping cart, and/or your username and/or password. All of these purposes serve to improve and personalize your experience on our Service. Most Web browsers can be set to inform you when a cookie has been sent to you and provide you with the opportunity to refuse that cookie. Additionally, if you have a Flash player installed on your computer, your Flash player can be set to reject or delete Flash cookies (technically known as Flash "local shared objects"). However, refusing a cookie may, in some cases, preclude you from using, or negatively impact the display or function of, the Service or certain areas or features of the Service.

We also may use "clear GIFs" (aka "Web beacons" or "pixel tags") or similar technologies (e.g., java script tags), in the Service and/or in our communications with you. A clear GIF is typically a one-pixel, transparent image, located on a Web page or in an e-mail or other type of message, which is retrieved from a remote site on the Internet enabling the verification of an individual's viewing or receipt of a Web page or message.

Our server automatically collects data about your server's Internet address when you visit us. Tracking technologies may record information such as Internet domain and host names; Internet protocol (IP) addresses; browser software and operating system types; clickstream patterns; and dates and times that our Service is accessed. We may use this information for internal system administration, to help diagnose problems with our servers, and to administer the Service. Such information may also be used to gather broad demographic information, such as country of origin and Internet Service Provider.

We may make recommendations to you about movies and other content based on past items that you have licensed from or otherwise viewed on the Service.

Any or all of these activities with regard to non-personally identifiable information, as described above or elsewhere in this Privacy Policy, may be performed on our behalf by our agents and services providers (including, for example, iN DEMAND).

Information Uses for Promotional Purposes and Account Management

We and our agents and service providers (who may assist us in connection with the Service) may combine personally identifiable and non-personally identifiable information, and retain and use Account Data and other personally identifiable information, as well as non-personally identifiable information in providing the Service to you, which uses may include, without limitation, the following:

  • to permit you to obtain and pay for licenses for downloading and renting of digital content on the Service;
  • to administer those licenses and to enforce their terms (including the Terms of Use and the applicable Usage Rules, as such term is defined in the Terms of Use);
  • to send you emails and other notifications about new movies, television shows and other digital media, as well as related products and services;
  • to customize the Service to your preferences and with your recent account activity for ease of Service use and navigation;
  • to allow participation in our various promotional programs, including, for example, sweepstakes and contests (which, in some cases, may be co-sponsored, as further described below), that we may offer from time to time on our Service;
  • to respond to your inquiries or requests, including without limitation, your customer service needs;
  • to improve the Service, including, for example, after research and analysis, for future marketing and/or promotional use about us or our services and features;
  • to survey visitors about various topics, including their viewing information or other entertainment preferences;
  • to allow participation in public or interactive areas of the Service, including, for example and without limitation, comment boards; and
  • for any other purpose disclosed to you at the time you are asked to submit your personally identifiable information on or through the Service.

Users may be able to send information about our products and services to their friends and family members through the Service by clicking on an “E-mail to Friend” or similar button on our Service or in an e-mail that we have sent. In some of these cases (unless our e-mail is simply forwarded by the user), users may be able to provide the name and e-mail address of their friend or family member to us. Such information will be treated in accordance with this Privacy Policy.

Promotional Uses and Disclosures Involving Third Parties

Some of the offers we make available on or through the Service may be provided jointly by us and our third-party promotion or marketing partners (e.g., in the case of co-sponsored contests, sweepstakes and other offerings), or by such third parties independently, who have services, products and offers that might be of interest to you. For example, if you are a winner of a sweepstakes or other promotion that we have run with a third party, we will provide your information to such third party, which will use your information in connection with such sweepstakes or promotion and also for its own purposes, in accordance with its own policies. You also may be able to provide your information directly to these third parties (as further described below). (We may also make your personally identifiable and other information available to our affiliated and related companies, and they, in turn, may make such information available to such other third parties for such purposes.) Any such sharing by us will be in accordance with your promotion-preference settings, which are established upon registration completion and may be changed by you at any time by visiting the preferences area of your account on the Service, or as you may otherwise elect thereafter. We also may provide additional choices to you for use of and/or disclosure of your personally identifiable information as part of the relevant promotion.

You may have an opportunity on the Service to visit, or link to, other sites not operated by us, including other Web sites operated by our parents, affiliates and subsidiaries, or by unaffiliated third parties, such as our marketing partners. These third parties may maintain separate privacy policies governing the collection, use and disclosure of your personal information, which you should review for more information. Once you leave our Service, use of any information you provide will be governed by the privacy policy of that site’s operator. We are not responsible for the collection, use and disclosure practices of such other site operators with respect to personally identifiable and other information of third parties.

However we have obtained personal information – whether you or a third party provides it to us – please understand that we may combine it with information about you that we may have obtained from other sources. Such additional information helps us better understand your interests and preferences and allows us to send email and other communications to you that will be of more interest to you. If you do not wish to hear from us about any such promotions, please contact us via the methods stated in those communications or as otherwise discussed in this Privacy Policy. Please understand that if you opt out of receiving promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us.

We also may disclose to third parties aggregate statistics and other non-personally identifiable information, as a measure of interest in, and use of, our Service and communications (e.g., our e-mails), in the form of aggregate data, such as overall patterns or demographic reports that do not describe or identify any individual user.

Information Use for Service Operations, Corporate and Legal Compliance

We also may use or disclose your personally identifiable information for the following reasons:

  • performing standard business operations, such as transaction and payment processing, billing, collections, and accounting;
  • protecting our and our content providers’ business interests, including maintaining Service operation and user adherence to the Terms of Use and Usage Rules;
  • investigating or helping to prevent unlawful activity or activity that may threaten our visitors, users, employees, or property; and,
  • in cooperating with law-enforcement investigations, or as required by law or by, subpoena, warrant, or other order of the court or governmental agency;

To help us perform these functions, in addition to iN DEMAND, we may retain third parties to whom we disclose personal information. These third parties include our customer-service providers, who handle your inquiries and store your Account Data; credit-card, debit-card and similar transaction processors; technical-service providers, web site or database hosting companies, e-mail service providers, address list hosting providers, fulfillment companies, distribution companies or similar entities that maintain the Service operations; attorneys; accountants; and auditors; all of which use the disclosed information on our behalf.

We may also disclose your personal and other information to our parent companies, affiliates or subsidiaries; and to other entities in conjunction with the reorganization or sale of our stock or assets, or if we are involved in bankruptcy or other liquidation or consolidation procedures.

Furthermore, we will release your information (including your personally identifiable information) if required to do so by law, or by search warrant, subpoena or court order, and we may disclose such information if we have a good faith belief that such disclosure is reasonably necessary to protect our rights, property or personal safety, or that of our customers or the public.

Digital-Media Player Software

When you download and install the digital-media player software (the “Software”) to access and watch the digital content on the Service, the Software will not access computer files or other information on your computer that are not used by or otherwise related to the Service. Additionally, the Software will not provide us with information related to such digital content on your authorized device and/or your use of it. However, the Software may provide us with information about you, your authorized device’s operating system, software, amount of available disk space, and Internet connectivity. Your downloading and use of such Software is also subject to the Digital Media Player End User License Agreement, which you agreed to and accepted at the time you initially downloaded the Software, and into which this Privacy Policy is incorporated by reference.

Security

We endeavor to protect your sensitive personal information provided to the Service from unauthorized access, use or disclosure. Unfortunately, while we strive to protect the security and integrity of your personal information, we cannot guarantee or warrant such protection and cannot be responsible for the theft, destruction or inadvertent disclosure of your personal information.

Use of Comment Boards and Public Areas

Please remember that the comment boards and other similar areas are public areas on our Service and any information posted in these areas can be viewed by other visitors or Internet users. Whenever you give out personal information, such as screen names or email addresses, on such a “public” venue online, that information can be collected and used by people you do not know. If you choose to voluntarily disclose information in any comment board or similar forum that may be available on our Service, the protections of this Privacy Policy will not cover such disclosure of information. We urge you to use caution when disclosing any personal information on these venues. We are not responsible and will not be liable for any opinions, content or other materials posted by users on any such venues, or for the use by other visitors or third parties of any information or content you may post to such venues.

If you use our comment boards or other public venues, we will identify you by the screen name that you create. You agree that you will not disclose personally identifiable information relating to any other person in a public area of our Service without that person’s express consent.

By providing Personal Information to this Service, you understand and consent to the collection, maintenance, processing and transfer of such information in and to the United States and other countries and territories. This Service is intended for users who are located in the United States of America. This Privacy Policy shall be interpreted under the laws of the United States.
